Süreç 2021 Yılında Başlamıştı
Yaklaşık 35 hanenin bulunduğu 7 binayı kapsayan bölge, 2021 yılında "rezerv yapı alanı" ilan edilmişti. Hak sahiplerinin açtığı davada ilk aşamada iptal kararı verilmesine rağmen, istinaf mahkemesinin kararı bozmasıyla hukuki süreç uzadı.
2023 yılında 6306 sayılı Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun'da yapılan değişikliğin ardından bölge için pay satış ihalesi gerçekleştirildi Mahalle sakinleri, tapularının satışa çıkarıldığını ancak muhtarlığa yapılan tebligatla öğrendi. Tapular, Pelit İnşaat ve Nar Enerji firmalarına devredildi. Boğaz manzaralı bu daireler için hak sahiplerine yatırılan bedellerin komik bir rakamda kalarak 1 milyon 270 bin TL ile 2,5 milyon TL arasında değiştiği belirtilmişti.
Mahkeme: "Mülkiyet Hakkı İhlal Edildi"
Sözcü'de yer alan habere göre; İstanbul 14. İdare Mahkemesi, tapuların hak sahiplerinin bilgisi dışında ve gerçek değerinin çok altında satıldığı yönündeki iddiaları haklı buldu. Mahkeme, mülkiyet hakkının ihlal edildiğine hükmederek satış işlemini resmen iptal etti.

Deed Annulment Decision in Poligon Neighborhood: Residents Win Legal Battle!
A joyful legal development has occurred for the residents of the Poligon Neighborhood in Sarıyer, Istanbul, following a crisis that began when the title deeds of dozens of families were transferred to private companies through a tender. The Istanbul 14th Administrative Court has annulled the sale transaction on the grounds of "violation of property rights."
The Process Began in 2021
The area, which includes 7 buildings housing approximately 35 families, was declared a "reserve building area" in 2021. Although an annulment decision was initially granted in the lawsuit filed by the rightful owners, the legal process continued after the regional administrative court overturned the decision.
Following the amendment made in 2023 to Law No. 6306 on the Transformation of Areas Under Disaster Risk, a share sales tender was held for the region.
Residents stated that they only found out their deeds were put up for sale through a notification sent to the neighborhood headman (muhtar).
The title deeds were transferred to Pelit İnşaat and Nar Enerji.
It was reported that the amounts deposited to the property owners for these apartments with Bosphorus views were remarkably low, ranging between 1 million 270 thousand TL and 2.5 million TL
Court Rules: "Property Rights Violated"
According to the report by Sözcü, the Istanbul 14th Administrative Court examined the sale transaction under the scope of claims that the deeds were sold without the knowledge of the rightful owners and well below their actual market value. The court officially annulled the sale, ruling that it constituted a distinct violation of property rights.
